Four Steps to Prepare for Bankruptcy

Bankruptcy is never an easy decision, but if you have determined it’s your only choice, it is important that you are prepared. There are many steps you can take to ensure the bankruptcy process is as easy and streamlined as possible. If you plan to file, here are four steps to consider.

  1. Don’t Be in Denial

When you get behind in your bills, it can be tempting to just ignore the phone calls and letters and be in a state of denial. This is not good for a multitude of reasons. It’s essential you are aware of your current financial status so you can determine which resolution is best for you. Bankruptcy is a serious choice, and should only be made when you have no other options.

  1. Get Your Credit Reports

You are entitled to a free credit report every year, so request a copy from each of the three reporting companies – Experian, Trans Union, and Equifax. Look for any potential lawsuits or public records. Also, see if your employer is listed on your report. Creditors often use this information to contact your employer, something that is illegal, and something you want to prevent.

  1. Find a Bankruptcy Attorney

Finding a good lawyer that will help you through the process is essential. Find someone you can trust, or who comes highly recommended from someone you know. You will also want an attorney who is willing to accept payments for their bankruptcy fee. A good bankruptcy attorney will give you a list of all the paperwork he requires before he can file your case. Such paperwork includes tax returns, paycheck stubs, and copies of all credit card statements.

  1. Get Your Case Filed

Getting your case filed is the final step. Once this is done, you are given protection from the court, and the creditor calls and letters will stop. You will be required to attend a bankruptcy hearing and your attorney will guide you through the process.

If you have determined bankruptcy is your only choice, it is important you are as organized as possible. It isn’t an easy process, but it will be made simpler if you are prepared. In addition, you must find a bankruptcy or real estate attorney that will help you through the arduous process, especially if you are a homeowner who wants to keep their home. It is important you find a lawyer that you can trust, and who is experienced in bankruptcy law. If you are seeking bankruptcy counsel, please contact us today!
