Foreclosure Defense: Issuance of Title

After the issuance of title, the plaintiff may pursue a deficiency judgment which becomes a lien against the homeowner when the foreclosure sale did not generate sufficient funds or pay the mortgage in full. The plaintiff has the legal right to pursue the full amount of any unpaid balance. The plaintiff must either file a motion for a deficiency within one year of the judgment, or the lender may file a separate action for a deficiency within five years of the judgment.
