You can definitely stay in your home during the foreclosure process. Remember, the foreclosure is the bank’s lawsuit to recover the property but the titled owner of the property during the process is you, the homeowner. The warranty deed or whatever the instrument of conveyance is, is in your name.
So, by virtue of that you also have possession and the right to stay in the property during the foreclosure process. Many individuals who suffer some very extreme hardships are unable to process a loan modification because they can’t show the income so they have no choice but to stay in the home during the process and maybe find a way out or find a way to improve or increase their income to then modify but, of course, they stay in their home during the process.
