During the building of your property or your house you’re seeing that there are certain construction defects, you first have to determine if those really are construction defects. You may not be in a position to make that determination but generally what I’ve seen done or what I’ve had clients do is to hire an independent engineer to review the work that’s being done and if it truly is a construction defect you need to immediately bring that to the attention of the contractor, the developer.
You also need to document it; you need to put it in writing to place the contractor or the developer on notice that there is this potential defect. The defect could rise to the levels where you may want to terminate the contract and, if so, you need to put that in writing. But the first step in responding to construction defects is to hire an engineer and ascertain whether these problems are truly construction defects.
